Privacy Act Statement
AUTHORITY: The Merit Systems Protection Board (MSPB) may collect information as authorized by the Freedom of Information Act (FOIA), 5 U.S.C. § 552, the Privacy Act of 1974 (Privacy Act), 5 U.S.C.§ 552a, as amended, and 5 C.F.R. § 1201.53.
PRINCIPAL PURPOSE(S): This information is being collected for the primary purposes of responding to requests for information pursuant to the above statutes and regulations. Specifically, collection of this information will be used for the purpose of processing requests for information and administrative appeals under the FOIA, Privacy Act, and MSPB’s regulations, including any tasks related to the administration of these requests and appeals.
ROUTINE USE(S): The information collected may be shared outside of MSPB as generally permitted under 5 U.S.C. § 552a(b) of the Privacy Act. This includes sharing the information as necessary and authorized by routine uses published in MSPB – 3, Freedom of Information Act/Privacy Act Case Records, 54 Fed. Reg. 11826 (March 22, 1989), and upon written request, by agreement, or as required by law. The information provided may also be disclosed to another agency (a) with an interest in the record in connection with a referral of a FOIA request to that agency for its views or decisions on disclosure or (b) in order to consult with and obtain recommendations concerning matters on which the agency has equities in the information and has specialized experience or particular competence that may be useful to MSPB in making required determinations under the FOIA. The information provided may also be included in some information in a publicly-available log of FOIA requests.
